Of the Portal and Platform of Fluxo Technologies SAPI de CV ("Fireflux"). These Terms of Use are effective as of Jun 7, 2024.

Welcome to the "Fireflux" website. Please read these terms carefully before contracting a service through our website or any other electronic platform, and/or before contracting any of our services directly and using our services in general. By starting to use this site or contracting our services, it is presumed that you have read and consented to these terms and conditions. By using this site electronically or any of our services, the User acknowledges that they have read and accepted these terms and conditions in their entirety and with all their legal scope.

The following terms and conditions for the use of the portal (the "Rules of Use") are applicable to all websites derived from or resulting from the use of Fireflux (the "Portal"), owned by Fluxo Technologies SAPI de CV.

For the purposes of these Rules of Use of the Portal, a user shall be considered as: (i) the general public and/or (ii) a Fireflux customer who has generated a user profile through our Portal and/or before contracting any of our services through the Portal or (iii) an officer of a Fireflux customer who uses the Portal to receive the services provided by Fireflux to the general market (the "User"). The User fully and unconditionally accepts both the Rules of Use of the Portal and the Privacy Notice (jointly, the "Legal Notice") published on the Portal. Fireflux reserves the right to update or revise these terms and conditions without prior notice and without the need for prior authorization from any third party; please review these terms and conditions periodically to be aware of any changes, without any responsibility for Fireflux. The continued use of this site after the publication of any change in these terms and conditions indicates that the User accepts such changes without reservation. Fireflux is a Mexican company that offers a portfolio of services consisting of the development of technology or various accessories of any nature in order to develop operational applications and help companies improve their processes without the need to use traditional programming code, generally through our Portal and Platform, as described on the Portal (the "Services"). Likewise, Fireflux is not committed to any political or governmental organization. The material contained on the Portal is for informational purposes of the services offered. These Rules of Use govern the use of the Portal, as well as any technology that may be used by Fireflux to provide its services to the general market (the "Platform") and your access to it constitutes a binding contract (an "Agreement") between Fireflux and the User. The Legal Notice is mandatory and binding for all Users. In case the User does not agree with the Legal Notice, in whole or in part, they must refrain from using, operating, visiting the Portal, the Platform, and/or contracting the services provided by Fireflux. By using the Portal, the Platform, and/or inducing its use electronically or through other means, the User indicates that they accept the Agreement and acknowledges and accepts that: (i) Fireflux disclaims all responsibility, loss, damage, or risk resulting directly or indirectly from the use of the Portal, the Platform, or the Services; (ii) the use of the Portal and the Platform is subject to the terms of the Legal Notice, as it may be modified from time to time; and (iii) they will only use the materials contained on the Portal and the Platform for personal, non-commercial, and informational purposes, and that they will not modify any of the materials contained therein.

General Description of the Services

In general terms, and subject to any more detailed provision, either in substance or processes applicable, that are implemented through the Portal or the Platform, for the provision of the Services: (i) the User may register with a username and password; (ii) the User must provide all the information necessary for the proper and timely provision of the Services; and (iii) the provision of the Services will be governed by the instructions that Fireflux makes available on the Portal and/or the Platform from time to time, which the User must comply with for the proper provision of the Services.

Any Fireflux User can create a free account, for which only their name and cell phone number will be required, in addition to creating an account on the Platform. Likewise, any User will create an Active Subscription when contracting the Services offered by Fireflux, in which they will have to add their address and a payment method.

Channels and Security Filters

Fireflux, at its sole discretion, may implement the security filters it deems appropriate to evaluate the Users and determine if the information provided by a User is reliable and secure, and if it decides to provide or interrupt the Services for a User, at its sole discretion. From the moment a User registers on the Portal or the Platform, the Fireflux team may filter with the aim of safeguarding the integrity of its collaborators, agents, partners, or shareholders, directors, and employees involved directly or indirectly in the provision of the Services.

To use the Services offered on the Portal, you may need to create an account and establish a password. In such a case, you are fully responsible for maintaining the confidentiality of your account information, including the password, and any and all activities that occur under your account as a result of your failure to maintain the confidentiality and security of such information. You agree to notify Fireflux immediately if there is any unauthorized use of your account or password, or if any security problem occurs. You may be legally responsible for losses incurred by Fireflux or any other user or visitor to the Portal due to the use of your account or password by another person as a result of your failure to maintain the confidentiality and security of the account information.

You may not use your account or password, or the account of another person, without the express permission and consent of the account holder. Fireflux will not be responsible for any loss or damage arising from your failure to comply with these obligations. Likewise, Fireflux reserves the right to temporarily or permanently cancel a user’s account (free or active) in case of non-compliance with the following User Conduct section.

User Conduct

The User agrees to comply with all local, state, national, and international laws, regulations, norms, and rules and is solely responsible for all actions or omissions that occur as a result of the use or access to the Portal or the Platform including, without limitation, the content of their transmissions through or to the Portal or the Platform. Without limiting the generality of the foregoing, the User agrees not to do the following:

Use the Portal or the Platform in connection with the commission of property crimes or any other type, particularly in the matter of anti-money laundering and anti-corruption.
Use the Portal or the Platform in connection with chain letters, advertising email, unsolicited advertising email, or any duplicate or unsolicited messages, commercial or otherwise.
Collect, compile, or disseminate information about third parties, including email addresses or personal data, without the consent of the owner of the information or data.
Create a false identity or a forged email address or header, or attempt in any way to mislead others about the identity of the sender or the origin of a message.
Transmit through or to the Portal or the Platform illegal, harassing, defamatory, abusive, threatening, harmful, vulgar, obscene, offensive, or objectionable materials.
Transmit any material that could infringe the intellectual property rights or other rights of third parties, including, without limitation, trademarks, trade secrets, or copyrights.
Transmit any material that contains viruses, Trojan horses, worms, time bombs, cancelbots, or any other harmful or damaging program.
Use the Portal or the Platform to infringe any applicable law that restricts the export or import of data, software, or any other type of content.
Interfere with, or disrupt, the operation of networks connected to Fireflux websites or infringe the rules, policies, rules, or procedures of such networks.
Obtain or attempt to obtain unauthorized access to the Portal or the Platform and Fireflux websites or other accounts, computer systems, or networks connected to Fireflux websites or the Platform, through illegal password searching or obtaining or by any other means.
Interfere with the use of the Portal or the Platform by any third party.
Use the Portal or the Platform in an unethical manner.
Use the Portal or the Platform to promote businesses for the benefit of any competing company or service.
Use any type of “deep-link,” “page-scrap,” “robot,” “spider,” or other automatic devices, programs, algorithms, or methodologies, or similar or equivalent manual processes to acquire, copy or monitor any part of the Portal, or to access them, nor may you reproduce or evade the navigation structure or presentation of the Portal, to obtain or attempt to obtain materials, documents, or information by any means that is not voluntarily available through it.
Explore, analyze, or evaluate the vulnerability of the Portal or any network connected to it, nor infringe the security or authentication measures of the same or any network connected to it.

It is expressly prohibited: (i) to use the Portal and/or the Platform and/or the Services for illegal, immoral, obscene, or prohibited purposes by custom and applicable legislation and/or the Legal Notice; (ii) to cause modifications, alterations, and/or deletions, made by electronic means or otherwise, using lawful or unlawful resources, that may interfere with the administration or operation of the Portal and/or the Platform and/or the Services provided by Fireflux.

Likewise, the user agrees to behave respectfully and in a friendly manner towards the instructor. Avoid malicious comments, racism, dark humor, insults, vulgarity, not sharing personal data, not sending photos and videos with sexual content or that may offend. See attached document regarding conduct.

The User will be responsible for damages caused to Fireflux derived from their acts or those of their officers, employees, agents, dependents, collaborators, and/or associated natural or legal persons, subsidiaries, and/or affiliates. If the user infringes any of the points mentioned in the Terms and Conditions, Fireflux without the need for prior notification, has the right to cancel and/or suspend the User's account, likewise, the user does not have the right to receive any refund and/or compensation from Fireflux.
